What is a child custody investigation?

A child custody investigation is an objective observation of a child’s well-being and treatment(emotional & financial) usually as part of a divorce, separation, or custody case.

A typical investigation involves an investigator assessing the treatment of a child by his or her parents or legal guardian. The conclusion of the investigator is then documented/reported to the court and used in custody evaluations. When going through a divorce or separation a child custody investigation will provide documented evidence without the bias.

How does a child custody investigation work?

A child custody investigator can use different methods to ascertain the treatment of a child. Surveillance is one of the most common methods used to determine how a parent or legal guardian treats their child. Investigators will legally document any abuse or neglect they witness in photos, videos/audio recordings. They can also interview potential witnesses, like family members, and conduct background checks on custodial parties. When investigating a parent, an investigator looks for things like alcohol abuse, criminal activity, reckless driving, gambling, drug abuse, abandonment and any other activities that negatively affect the child. They will also ensure that the parent is providing a safe, clean living space, healthy food, emotional support, and other necessities for their child. Investigators are trained to see the safety and support of the child as a priority. Any negative results can be admissible in a courtroom where the investigator can testified to his finders.

Do I need a child custody investigator?

Child custody investigations aren’t always necessary, but if the reasons below are of concern its best to speak to an investigator.

  • You are concerned about your child’s safety. If you believe your spouse is unfit to care for your child for any reason, a private investigator can potentially prove your allegations with objective, documented evidence. In a divorce case, documented evidence may be necessary to protect a child from an unhealthy environment. Ultimately, an investigator will work with you to keep your child away from an abusive situation.
  • For your own peace of mind. If you are unsure if your spouse is fit to care for your child, an investigator can legally look into their background, habits, and parenting style in order to prove or disprove their ability to meet your child’s needs. Documented evidence will be admissible in court and will provide you the comfort of knowing your child is safe.
  • Financial Support. If the supporting parent claims they are not working or are not meeting there payment arrangements on time, an investigator can document the activity of that parent and ascertain the work place. This documented evidence can all be admissible and presented in court.
  • You have been falsely accused of abuse or neglect. Especially in court with ugly divorces, one parent will sometimes make false accusations in order to limit the other parent’s access to their child. A private investigator can document evidence of proper conduct and can present it to the court, which may ensure you adequate time with your child.
